Welcome to Rush Gigs. These Terms and Conditions ("Terms") govern your use of the Rush Gigs mobile application and services (collectively, the "Service"). By accessing or using Rush Gigs, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service. Rush Gigs serves as a platform to connect job seekers with employers, facilitating direct communication and employment opportunities based on location.

1. Account Registration and Eligibility

To use Rush Gigs, you must be at least 18 years old and legally authorized to work in your jurisdiction. When creating an account, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify Rush Gigs of any unauthorized use of your account or any other security breach. Rush Gigs reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

2. Service Description and Limitations

Rush Gigs provides a platform that connects job seekers and employers through location-based technology. We facilitate introductions but do not employ workers or guarantee employment. All employment relationships are directly between users. Rush Gigs is not responsible for the quality, legality, or safety of jobs posted, the truth or accuracy of listings, the ability of employers to offer jobs, or the ability of job seekers to perform work. Users acknowledge that Rush Gigs does not pre-screen users or verify the accuracy of user-provided information, though we reserve the right to do so.

3. User Conduct and Responsibilities

Users agree to use Rush Gigs only for lawful purposes and in accordance with these Terms. You may not use the Service to post false, misleading, or fraudulent content; harass, abuse, or harm other users; violate any local, state, national, or international law; infringe upon intellectual property rights; transmit spam or unsolicited communications; attempt to gain unauthorized access to our systems; or engage in any activity that could damage, disable, or impair the Service. Users are solely responsible for their interactions with other users and any employment relationships formed through the platform.

4. Payments and Transactions

Rush Gigs currently does not process payments between employers and workers. All financial transactions, including wage payments, are handled directly between users outside of our platform. Users are responsible for complying with all applicable tax laws and employment regulations. Rush Gigs is not responsible for any payment disputes between users. We recommend that users establish clear payment terms before beginning work and maintain appropriate records of all transactions. Future premium features may involve fees, which will be clearly disclosed before purchase.

5. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, describes how we collect, use, and protect your information. By using Rush Gigs, you consent to our data practices as described in the Privacy Policy. You grant Rush Gigs a non-exclusive, worldwide, royalty-free license to use, reproduce, and display content you post on the platform for the purpose of operating and improving the Service. You retain ownership of your content but are responsible for ensuring you have the right to share it.

6. Safety and Security Guidelines

While Rush Gigs strives to maintain a safe platform, users must exercise caution when interacting with others. We recommend meeting in public places for initial meetings, verifying the identity and credentials of other users, never sharing sensitive personal information like social security numbers or bank account details through the app, and trusting your instincts if something seems suspicious. Report any inappropriate behavior, safety concerns, or Terms violations to our support team immediately. Rush Gigs reserves the right to investigate and take appropriate action, including account suspension or termination.

7. Ratings, Reviews, and Content

Users may leave ratings and reviews after completing jobs or hiring through the platform. Reviews must be honest, accurate, and based on actual experiences. You may not manipulate ratings through fake accounts or coercion. Once posted, ratings and reviews generally cannot be removed unless they violate our content policies. Content that is defamatory, discriminatory, threatening, or otherwise inappropriate will be removed. Rush Gigs reserves the right to moderate all content but is not obligated to monitor or remove any specific content.

8. Intellectual Property Rights

The Rush Gigs Service, including all content, features, and functionality, is owned by Rush Gigs and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission. The Rush Gigs name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Rush Gigs. You must not use such marks without our prior written permission.

9. Limitation of Liability and Disclaimers

RUSH GIGS IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUSH GIGS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RUSH GIGS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO RUSH GIGS IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

10. Changes to Terms and Contact Information

Rush Gigs reserves the right to modify these Terms at any time. We will notify users of significant changes through the app or via email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.
