Terms and Conditions
These Terms govern use of the Rush Gigs website, mobile application, and related services.
By accessing or using Rush Gigs, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.
1. Eligibility and accounts
You must be at least 18 years old and legally permitted to perform or arrange the work involved in your jurisdiction. You agree to provide accurate, current information, protect your account credentials, and notify Rush Gigs about unauthorized account use. You are responsible for activity under your account.
2. Marketplace role
Rush Gigs provides technology that helps users post work, discover nearby activity, apply, review user-provided information, and communicate. Rush Gigs facilitates introductions but does not employ workers, supply employees, act as a staffing agency, or guarantee employment, applicants, matches, attendance, completed work, or a particular outcome.
Work relationships and agreements are directly between users. Rush Gigs does not guarantee that a user, post, profile, skill, credential, review, location, or other user-provided information is accurate or that a user has been prescreened.
3. User responsibilities
You agree to:
- Use Rush Gigs only for lawful purposes.
- Describe work, qualifications, availability, and compensation accurately.
- Confirm the person, task, schedule, place, payment, and risks before proceeding.
- Follow applicable labor, tax, licensing, safety, anti-discrimination, and other laws.
- Use appropriately trained or licensed people where the work requires it.
- Respect other users and their privacy.
You may not post false or misleading content, conceal hazards, harass or exploit another person, impersonate someone, manipulate ratings, send spam, distribute malware, access systems without authorization, or use Rush Gigs to facilitate unlawful conduct.
4. Posts, applications, and communications
A post is a request or opportunity, not confirmed work. An application expresses interest, not a guaranteed selection or agreement. Users should use the available communication tools to confirm material terms before work begins and to address material changes.
You retain ownership of content you submit. You grant Rush Gigs a non-exclusive license to host, process, reproduce, and display that content as reasonably necessary to operate, secure, and improve the service. You represent that you have the right to submit it.
5. Compensation and purchases
Rush Gigs does not currently process compensation for work. Workers and hirers are responsible for agreeing on the amount, timing, and payment method and for handling payment, records, taxes, disputes, and legal responsibilities directly.
The app may offer optional purchases or premium features. Any price and purchase terms must be displayed before the user purchases. An app-store purchase is also subject to the applicable store terms.
6. Electronic communications
Rush Gigs may send service-related email, push, or SMS communications such as account verification, security alerts, or activity notices. Message and data rates may apply. Where an SMS program supports it, reply STOP to opt out and HELP for assistance. Opting out of essential communications may limit service functionality.
7. Safety
Use caution when interacting with other users or entering a worksite. Review the Safety guide, protect sensitive information, verify details relevant to your decision, and decline or leave a situation that is unsafe, unlawful, or materially different from what was agreed. Contact local emergency services for an immediate emergency.
8. Ratings, reviews, and moderation
Ratings and reviews must reflect genuine experiences and must not be manipulated, coerced, discriminatory, threatening, defamatory, or otherwise unlawful. Rush Gigs may investigate content and may remove content, restrict features, suspend accounts, or terminate access when reasonably necessary to enforce these Terms or protect the service.
9. Intellectual property
The Rush Gigs service, software, name, logos, and company-created content are protected by applicable intellectual-property laws. You may not copy, modify, sell, lease, reverse engineer, or distribute protected portions of the service except as permitted by law or with written authorization.
10. Disclaimers and limitation of liability
Rush Gigs is provided “as is” and “as available” to the maximum extent permitted by law. Rush Gigs disclaims warranties that the service will be uninterrupted, error-free, secure, or suitable for a particular task and disclaims responsibility for user conduct or agreements.
To the maximum extent permitted by law, Rush Gigs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the service or an interaction between users. Nothing in these Terms excludes liability that cannot legally be excluded.
11. Suspension, termination, and changes
Rush Gigs may suspend or terminate access when reasonably necessary to address fraud, abuse, safety, legal requirements, or a violation of these Terms. Rush Gigs may update the service and these Terms. Material changes will be identified through an appropriate notice or updated effective date. Continued use after a change takes effect means you accept the updated Terms.
12. Governing law and contact
These Terms are governed by the laws of the State of California and applicable United States law, without regard to conflict-of-law rules, except where another law must apply. Use the Contact page for questions about these Terms.
